Which rules sit behind these terms
Three published rules bound the way the clauses above are written. The warranty is designated under the Magnuson-Moss Warranty Act, the delivery clause is read against the mail-order rule's stated-time duty, and the limitation of liability stops where California law says no contract may exempt a party from its own fraud or wilful injury.
- 15 U.S.C. § 2303 — the word “limited” in section 5. A written warranty on a consumer product costing more than $10 must be designated “full (statement of duration)” if it meets the federal minimum standards in § 2304, and “limited warranty” if it does not. Section 5 states a 12-month limited warranty: it remedies defects in materials and workmanship, and it does not carry the § 2304 minimums.
- 16 CFR § 435.2 — the delivery clause in section 4. A seller may not take an order without a reasonable basis to expect shipment within the time it states, or within 30 days if it states none. “Delivery dates are estimates and not guaranteed” is therefore a lawful sentence only because the stated windows in our Shipping & Returns Policy are the ones we commit to — and if a date has to move, the buyer is offered a revised date or a cancellation with a prompt refund.
- California Civil Code § 1668 — the outer edge of section 6. “All contracts which have for their object, directly or indirectly, to exempt any one from responsibility for his own fraud, or willful injury to the person or property of another, or violation of law, whether willful or negligent, are against the policy of the law.” Section 6 limits liability “to the fullest extent permitted by law”; that phrase is doing real work, and this section is the reason we state a limit rather than claim an exemption.
